These Terms of Use ("Terms") govern your use of Transcribd ("the App"), developed by Rene Zelaya, operating as MITM LLC ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device that you own or control, in accordance with the Apple Media Services Terms and Conditions and the Usage Rules set forth in those terms.
Transcribd is a file transcription application for macOS that uses on-device machine learning models to convert audio recordings to text and identify individual speakers. All audio processing occurs locally on your Mac.
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
The App uses machine learning models for speech recognition and speaker diarization. Results may not be perfectly accurate and may vary based on audio quality, background noise, accents, number of speakers, and language. You are solely responsible for reviewing and verifying any transcription output before relying on it.
The App, including its design, code, and branding, is owned by Rene Zelaya, operating as MITM LLC, and is protected by copyright and other intellectual property laws. The speech recognition and diarization models used by the App are provided under their respective open-source licenses.
You retain all rights to any audio you process and any text generated through transcription. We do not claim any ownership or rights over your content. Since all processing occurs on your device, we have no access to your content.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY TRANSCRIPTION OR DIARIZATION OUTPUT WILL BE ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RENE ZELAYA OR MITM LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.
Your use of the App is also subject to the Apple Media Services Terms and Conditions, including the Standard EULA available at apple.com/legal/internet-services/itunes/dev/stdeula. In the event of a conflict between these Terms and the Standard EULA, the Standard EULA shall govern.
We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
